Terms, Conditions & Service Agreement

These Terms & Conditions set out the agreement between you (“Client,” “You,” or “Participant”) and Bonnie Walker trading as Bonnie the Doula (“We,” “Us,” or “Our”).

By purchasing, enrolling in, or accessing any of our courses, coaching programs, or online events, you agree to these Terms & Conditions and our Privacy Policy.

Unless otherwise stated, all prices are in USD.

For Australian in-person doula clients, payments are made in AUD.

1. Services Covered

These Terms apply to:

  • Online courses (Together We Birth, Be the Best Birth Support, Birth Doesn’t Have to Be Scary)
  • Coaching packages (group or one-on-one)
  • Online workshops, masterclasses, or events
  • “Services” also include mentoring programs, including one-on-one or group mentoring for doulas, birth workers, or other professionals, whether delivered online or in person.

2. Scope of Services

What We Offer:

  • Birth mindset & preparation coaching (group & 1:1)
  • Access to self-paced courses including lessons, workbooks, and resources
  • Group coaching programs, masterminds, and workshops
  • WhatsApp, Zoom, Phone call, In-Person Support during coaching packages (as outlined in your package)

What We Don’t Offer:

  • Clinical tasks (blood pressure, cervical checks, foetal monitoring, etc.)
  • Medical advice, diagnosis, or treatment
  • Guarantee of specific outcomes

3. Payment & Fees

Payment is required to confirm enrolment in a course, coaching or mentoring program, or event.

Payment options include:
• Paid in full upfront
• Payment plan instalments as specified at checkout

By enrolling, you agree to pay the full balance, regardless of completion or attendance.

All fees are processed via Kajabi, Stripe, PayPal, or another nominated provider.

Prices are listed exclusive of any applicable taxes. Where required, VAT/GST or similar sales taxes will be added at checkout. You are responsible for any additional taxes or duties that may apply in your country.

In the event that any instalment or scheduled payment is not received on the due date, access to services may be suspended until payment is received in full. Where a payment remains outstanding for more than thirty (30) days, the entire outstanding balance of the package, course or program will become immediately due and payable. We reserve the right to issue an invoice for the full amount and to recover any unpaid sums through collections processes or legal action as necessary. Any costs incurred in recovering such amounts (including but not limited to legal fees and collection agency costs) will be added to the outstanding debt.

 

4. Refund Policy

Online Courses

  • The following online courses are covered by a 7-day refund policy:

    • Together We Birth
    • Be the Best Birth Support
    • Birth Doesn’t Have to Be Scary

    If you are not satisfied with your purchase, you may request a full refund within seven (7) days of your original purchase date.

    Refund requests must be submitted in writing via email within the 7-day period. Requests received after this timeframe will not be eligible for a refund. Upon approval, access to the course materials will be revoked.

  • Course access is granted for the life of the course, not for your lifetime. We reserve the right to retire or discontinue a course at any time, but will give you reasonable notice if this occurs and offer alternatives.
  • All courses and digital resources are delivered electronically. Delivery is complete when login details or access instructions are sent to the email you provide.

  • One-to-One Mentoring

    All one-to-one mentoring services, whether provided to doulas, birth workers, or private clients, are non-refundable unless otherwise required under Australian Consumer Law. Payment plans are a commitment to pay the full program fee. Failure to complete instalment payments does not cancel the remaining balance owed. Access to mentoring materials, sessions, or program resources will be suspended if payment obligations are not met.

    Due to the personalised nature of one-to-one mentoring, including the reservation of scheduled session times, preparation, tailored guidance, and the allocation of limited client capacity, all payments made toward private mentoring services are final.

    By purchasing one-to-one mentoring, you acknowledge that you are securing dedicated time, expertise, and availability, and therefore refunds will not be provided for change of mind, scheduling conflicts, partial participation, or unused sessions.

    In exceptional circumstances, rescheduling may be offered at our discretion, but this does not constitute grounds for a refund.

  • Mentoring Session Attendance: Where mentoring includes scheduled live sessions (group or one-on-one), the Client is responsible for attending sessions at the scheduled time. Group mentoring sessions cannot be rescheduled. Recordings may be provided where applicable to the specific program.
  • 1:1 Coaching: Sessions may be rescheduled with a minimum of 24 hours’ notice. Missed sessions without notice may be forfeited. Packages must be used within the timeframe outlined at purchase. If you experience pregnancy loss during a coaching package, options for applying remaining sessions or credit will be addressed in line with the specific contract you signed at purchase.

Events & Workshops

  • If an event is cancelled by us, you will receive a full refund or credit.
  • If you are unable to attend, refunds are not available. You may request to transfer your ticket to another event (subject to availability and at our discretion).

Compassionate Consideration

  • Any compassionate exceptions apply only as outlined in the specific contract you signed at the time of purchase (e.g. coaching agreement or event agreement).

5. Client Responsibilities

By enrolling, you agree to:

  • Take full responsibility for your health, choices, and outcomes
  • Engage fully in coaching, courses, or events
  • Use WhatsApp/email support respectfully within agreed boundaries (e.g. not for emergencies)
  • Treat group spaces and other participants with respect

  • Mentoring programs are educational and advisory in nature. Mentoring is not therapy, counselling, medical advice, legal advice, financial advice, or business consulting services requiring licensing or regulatory oversight.

    Participation in any mentoring program does not guarantee business success, income, client bookings, professional accreditation, certification, regulatory approval, or any specific outcome.

    The Client acknowledges that results depend on individual effort, experience, circumstances, market conditions, and implementation.

Age Requirement

  • Our coaching services are intended for adults. By enrolling in a coaching package, you confirm you are at least 18 years old.

6. Intellectual Property

  • Program materials, templates, frameworks, scripts, business tools, pricing models, documents, and training content provided remain the intellectual property of Bonnie the Doula and may not be copied, reproduced, shared, resold, or distributed without written permission.
  • Materials are for personal use only.
  • Copying, distributing, or reselling content without written permission is prohibited.

7. Disclaimer & Waiver of Liability

By enrolling in any course, coaching program, or event offered by Bonnie the Doula, you acknowledge and agree that:

  1. Non-medical role
    Bonnie Walker is not a medical professional and does not provide clinical care, diagnosis, or treatment. All Services are educational, supportive, and informational only.
  2. Healthcare responsibility
    You are responsible for seeking medical advice and care from your chosen healthcare provider for any health-related or pregnancy-related concerns.
  3. No guarantee of outcomes
    We cannot and do not guarantee any particular birth, postpartum, or coaching outcome.
  4. Release of liability
    To the fullest extent permitted by law, you release and hold harmless Bonnie Walker trading as Bonnie the Doula, her employees, contractors, and representatives, from any claims, damages, or liabilities that arise from your pregnancy, labour, birth, postpartum, or use of our Services, except where gross negligence or intentional misconduct can be proven. This release applies equally to all Services, including coaching programs, online courses, workshops, and events.
  5. Professional ResponsibilityMentoring participants remain solely responsible for their own business decisions, professional conduct, client contracts, regulatory compliance, insurance coverage, and legal obligations.Bonnie the Doula is not liable for actions taken by mentoring participants in their own businesses or professional practice.
  6. No future claims
    You, your partner, or family members agree not to initiate any claim or suit against Bonnie Walker or her representatives now or in the future, except in cases of proven gross negligence or intentional misconduct.

Consumer Law

  • These Terms are governed by the consumer laws of Australia. If you are purchasing from outside Australia, you may also have rights under the consumer laws of your own country. Nothing in these Terms seeks to exclude any mandatory protections you may have under applicable law.

8. Termination of Services

We may limit or withdraw access (without refund) if you:

  • Breach these Terms & Conditions
  • Share course materials without permission
  • Are disruptive or abusive in group programs

9. Governing Law

These Terms are governed by the laws of Western Australia and applicable Australian law. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.

10. Force Majeure

We are not responsible for cancellations, rescheduling, or changes caused by circumstances beyond our reasonable control, including but not limited to illness, emergencies, strikes, natural disasters, technical issues, or pandemics. In such cases, we will make every effort to provide equivalent services at another time.

11. Privacy

Our collection and use of personal information is governed by our Privacy Policy. By enrolling, you consent to us storing and using your information in line with that policy, including compliance with international data protection laws such as the GDPR (Europe) and CCPA (California).
